1.1. These Conditions shall supersede all earlier conditions of Com 4 Ltd. 1.2. These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of a director of Com 4 Ltd.
2. Definitions
2.1. "Com 4 Ltd" means Communication 4 Ltd trading as www.studentcomputers.co.uk. 2.2. "Customer" means the person, firm or company buying or agreeing to buy goods and services from Com 4 Ltd. 2.3. "Price Paid" means the price paid by the Customer for the Product excluding carriage and any credit surcharge. 2.4. "Order Confirmation" means the acknowledgement of the Customer's order sent to the Customer by Com 4 Ltd. 2.5. "Product" means any computer components supplied to the Customer by Com 4 Ltd.
3. Prices and Ordering
3.1. Prices on the website are displayed as ex VAT as well as inc VAT. 3.2. Overseas orders do not qualify for free delivery and will be subject to delivery charges as displayed at checkout. 3.3. Overseas and Non EU orders will be subject to local taxation. 3.4. Unless otherwise stated all prices are exclusive of delivery, insurance and installation. 3.5. The price payable by the Customer will be the price current at the date of the order. 3.6. Reservation of Products does not constitute an order and is not binding on either party. 3.7. Communication 4 Ltd reserves the right to cancel or refuse any order
4. Payment
4.1. Payment must be cleared in our account before goods will be dispatched.
5. Delivery
5.1. Any delivery date stated is only a warranty by Com 4 Ltd to use reasonable endeavours to effect delivery by that date. No liability will be accepted by Com 4 Ltd for failure to meet a stated delivery date. 5.2. Products supplied by Com 4 Ltd are delivered at the risk of Com 4 Ltd. If a parcel is delivered damaged then it must be signed for as 'Damaged'. Customers must inspect the goods immediately following delivery and contact the company within 24 hours to notify of any;
• damage caused in transit
• missing or lost items
Any claim for damage or loss must be followed up in writing. No claim for loss or damage due to delivery will be allowed if the Customer claims outside the above time limit. Your statutory rights are not affected. 5.3. If payment is made by credit or debit card, delivery will be made to the statement address of the cardholder.
6. Refunds
6.1. If you are a consumer (a private person buying for their personal use) then you may cancel your purchase at any time within 7 days of receipt and we will give you a full refund of the Price Paid (excluding any carriage costs). Outbound carriage to you is only free if you keep the goods. Should you wish to return the goods, carriage will be deducted at £13 + VAT for a computer system or laptop (covers couriered delivery). Return carriage to Com 4 Ltd is the consumer’s responsibility. Carriage deductions for refunds of goods sent and returned outside the UK mainland will be at the total cost of outbound and inbound delivery - be warned, this can be a considerable amount for a computer system sent to the Channel Islands - in the region of £70 - £100. Exclusions - We do not offer refunds for trade or business sales (a person buying for business use or for re-sale), so please be certain of your intention to keep the goods before making your order.
You must inform Com 4 Ltd in writing/email at "contact us" to be issued a returns number. The goods must be returned to us within 7 days from when the returns number has been issued; in the same condition you received them, at your own cost and risk. Products must be unused and be returned in their original packaging. If an item is returned without prior written notification or without a returns number, then Com 4 Ltd reserve the right to refuse a refund and charge for re-delivery.
6.2. If a customer wishes to return Products not covered by clause 6.1 then such products may be accepted at the discretion of Com 4 Ltd and will be subject to a minimum £25 administration fee in addition to the standard return fees described in 6.1. The customer must obtain authorisation from Com 4 Ltd before returning goods - unauthorised returns will not be accepted.
6.3 Refunds may take up to 30 days to process and be refunded to your account.
7. Faulty Goods
In the unlikely event that the goods are found to be faulty, please notify Com 4 Ltd as soon as possible. The goods may need to be returned to us to be examined if necessary to determine the cause of the fault. Provided that the goods have been used in a manner consistent with the manufacturer’s instructions; and that the fault has not occurred due to the consumer’s misuse of the goods, Com 4 Ltd will offer to either repair, replace or refund the faulty item and refund any associated delivery costs.
This clause does not affect your statutory rights.
8. Guarantee / Warranty
8.1. Warranties are usually specific to individual products - please see the documentation that was supplied with your product. As a guide, new computers and laptops usually come with 1 year, new batteries with 6 months and refurbished laptops with 30 days - unless otherwise stated. 8.2. A Product covered by a direct warranty from the manufacturer is not covered by any other guarantee. The Customer will receive a warranty direct from the manufacturer and should claim under this warranty. 8.3. The Customer should return the Product in its original packaging to Com 4 Ltd at the address above. Prior authorisation must be obtained for any returns by contacting Com 4 Ltd customer services and obtaining written authorisation to return. 8.4. Unless otherwise stated, all refurbished laptops come with a 30 day 'Return To Base' warranty. Should your unit fail and require repair within 30 days of receipt, please contact us via the website and we will issue a returns number. You goods will be repaired or replaced and returned to you. For orders outside the UK mainland, you will be liable for costs above the standard UK mainland rate. 8.5. If any item is returned which is found not to be faulty by our technicians, then a £25 testing fee, plus carriage costs, will be made and must be received before items can be returned. 8.6. This clause does not affect your statutory rights.
9. Liability
9.1. Com 4 Ltd will be liable for any losses you suffer as a result of us breaching these conditions if the potential consequences were reasonably foreseeable to both Com 4 Ltd and yourself when you first used the website, or a contract between ourselves regarding the sale of goods was initiated. We will not be held responsible or to account for any business loss (including loss of profits, revenue, contracts, anticipated savings, goodwill or wasted expenditure) or any other indirect or consequential loss that was not foreseeable to you or us resulting from when you first used the website or a contract between ourselves regarding the sale of goods was initiated. Com 4Ltd does not limit in any way our liability by law for death or personal injury caused from our negligence, breach of duty or wilful misconduct.
10. Uncontrollable Events and Delays
10.1. In case of delays caused by circumstances beyond the control of Com 4 Ltd or it's suppliers, Com 4 Ltd shall have the right to either suspend delivery or to cancel the contract without liability. 10.2. Examples of Uncontrollable Events are (by way of example and not limited to) strike, lockout, riot, revolution, war, epidemic, working difficulties, transportation difficulties, fire, and failure of suppliers or official regulations.
11. Customers Obligations
11.1. You are responsible for your own choice of Product and the suitability for any particular purpose. You must ensure that any Products are compatible. 11.2. You must provide reasonable courtesy information and co-operation to Com 4 Ltd. 11.3 VAT is automatically added to UK destination orders only. You are responsible for paying your own Tax at your countries going rate, in the case of International and offshore order destinations.
12. Title and Risk
12.1. Until full payment has been received by Com 4 Ltd for all Products whatsoever, supplied at any time by Com 4 Ltd to the Customer: - 12.2. property of the Products shall remain in Com 4 Ltd; 12.3. the Customer shall store the Products in such a way that they can be readily identified as being the property of Com 4 Ltd, and at all times in accordance with Com 4 Ltd recommendations; 12.4. subject to 12.5 and 12.6 below the Customer shall be at liberty in its own name (but not on behalf of or in the name of Com 4 Ltd) to sell the Products in the ordinary course of business, on the basis that any proceeds of sale shall be the property of and be held on trust for Com 4 Ltd;
13. Miscellaneous
13.1. If any part of these Terms and Conditions are found to be invalid or unenforceable by a court the rest are unaffected.

Important note about credit card chargebacks :
if a chargeback is made by the customer without legal justification an administration charge of £50 will be added to the total invoice amount outstanding as well as the fee charged by our merchant suppliers to issue a chargeback.
